What is Covered Relationship State?
Relationship State materially used to characterize, coordinate with, attribute authority to, or make consequential decisions concerning a person. It's a deliberately narrower category than the full Operant Dyad concept — it identifies only the subset relevant to the governance framework this paper develops.
What is Authority-Bearing State?
Within Covered Relationship State, the subset relied upon as evidence of permission, consent, delegation, approval, restriction, role, legal capacity, or institutional authority. It can remain historically accurate even after its legal significance has changed — the record that an employee approved something last year may remain completely true even if that employee no longer holds the authority to approve it today.
What is a Material Predicate, and what is Consequential Reliance?
A Material Predicate is a fact, authority, role, purpose, consent element, or other circumstance whose validity matters materially to whether continuing to rely on some state is presently justified. Consequential Reliance is use of Covered Relationship State in a manner reasonably capable of materially affecting legal rights, access, obligations, employment, financial interests, safety, or another comparably significant interest — a remembered preference for concise responses does not carry the same governance stakes as a remembered delegation authorizing a financial action.
What is Material Reconstitution?
Restoration or recreation of substantially equivalent operative state where the recreated state materially depends on previously corrected, restricted, revoked, retired, or otherwise invalidated state, and would restore substantially the same Consequential Reliance. The paper proposes that when Material Reconstitution occurs, the responsible actor should conduct the same renewed review that would have applied had the original state simply persisted — recreating the outcome should not function as a way around the review.
What is actually claimed?
That the relevant legal object for governing persistent AI relationship state is lawful continuing reliance, not ownership; that eight specific duties (visibility, contestability, provenance, revalidation, restriction, retirement, transition review, and reconstitution safeguards) follow from that reframing; and that existing law across privacy, agency, consumer-reporting, and records regimes already supplies partial analogues for each duty.
What remains unproven?
Whether this framework should ultimately be implemented as a single federal statute, model legislation adopted sector by sector, or a set of baseline principles layered onto existing regulators is explicitly left open. How often the underlying coordination failure actually occurs in deployed systems is not measured.
